1. Delivery and Shipping Policy

 

Delivery Timeline

Delivery Timelines vary for different products and delivery locations. Most orders are fulfilled within 1–4-days and a more specific estimate is displayed next to the details of every product on the website. Customers are advised to check delivery estimates before adding the product to the cart.

 

Delivery Methods and Costs

Delivery costs are displayed next to the shopping cart and again, right before the payment. Delivery charges could vary with the selection of product, delivery location and delivery method. We use courier services as well as reputed 3PL companies like DHL to ship orders to our customers. Available Shipping Methods and the corresponding charges are displayed at the time of placing the order. Here are the options that you might see, depending on your location:

Tracking of Packages

We promise tracked shipping on all orders. As soon as your order is shipped, you will receive an email with live tracking information on the email ID provided at the time of placing the order.

 

Undelivered or Lost Packages

In the event of a failed delivery attempt due to incomplete or incorrect delivery address, or even doorstep refusal, the product will automatically be returned back to our source warehouse. Any re-attempts or refunds will only be actioned after we receive the product and make contact with the customer to investigate the issue. In case your package is lost in transit, the shipping carrier will inform us and we will re-dispatch a fresh shipment.

 

International Shipping

We offer International Shipping to most countries and you will be able to see the costs once you select the country during the checkout process. As an ecommerce business, we have a global presence and in case the ordered product is not available locally, the order will be shipped from our central warehouse in the USA. International shipments are sometimes subject to special duties and fees that vary by country. At this time, we’re unable to collect payment for international duties and fees at checkout, so you may be required to pay them separately when your order is cleared through customs. We know this is not ideal, and are actively working to provide a better experience for our international customers. Should you choose not to pay or pick up your package, it will be returned to us which can take several weeks. Once the item is received and checked back into our system we will issue a refund. We would like to clarify that in such cases of cross-border shipping, import duties are borne by us and the customer has the right to get such costs reimbursed by contacting us via email and presenting the requisite and valid receipts.

 

Issues with Shipping and Delivery

Sometimes the carrier might prematurely mark orders as ‘Delivered’ leading to confusion at the customer’s end. In such events, you can either contact us or the carrier directly to resolve the issue. In the unlikely event of a delay in shipping your order, you are allowed to contact us via email and ask for an exact status of your order. We encourage customers to be aware of the delivery estimate before contacting us, so as to verify whether the presumed delay is concerning. We can be contacted on info@shopalong.co.za

 

 

We reserve the right to alter, modify or update the above policy at any point, without serving any prior notice to our customers. Such modifications are usually warranted to accommodate changes in laws and regulations, imposition of shipping restrictions or internal changes in our business.

 

 

2. Refund and Return Policy

Return or exchange requests can be made within 14 days of the delivery date.

To return or exchange any items, please email us at info@nshopalong.co.za clearly mentioning your order number and our customer support team will guide you on the process.

To be eligible for return, products must be in the exact condition you received them in. All packaging material must be undamaged and unused with the price tags intact.

Orders can be cancelled before dispatch. If the order has already been dispatched, cancellation fees might be charged.

Due to the nature of some of the products that we sell, we will not be able to replace or refund unwanted items if they have been opened or any seals are broken.

The refund will not include the import duties or the cost of delivery or return postage.

If your refund is approved, then it will automatically be credited to the original method of payment, within 5-10 days.

SHOPALONG reserves the right to alter and enforce this Return and Refund Policy at any time without having to serve a prior notice to users.

 

3. Privacy Policy

SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

 

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

 

SECTION 2 - CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

 

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

 

How do I withdraw my consent?

SECTION 3 - DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

 

SECTION 4 - SHOPALONG

Our store is hosted on Shopalong Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopalong’s data storage, databases and the general Shopalong application. They store your data on a secure server behind a firewall.

 

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopalong stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

 

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

 

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

 

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

 

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 6 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

 

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

 

SECTION 7 - COOKIES

Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.

 _Shopalong_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits

 _Shopalong_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.

SECTION 8 - AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

 

SECTION 9 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

4. Terms of Use

Shopalong provides an online platform located at www.shopalong.co.za (“the Website”) where you can purchase products to be delivered directly to you (“the Services”). This document sets out the terms in which Shopalong will provide its Services to you (“Terms”). By clicking ‘accept’ or purchasing any goods using the Services, you indicate your explicit and/or tacit acceptance of the terms and conditions listed below.

 

RELATIONSHIP BETWEEN THE PARTIES

The relationship between you and Shopalong is governed by these Terms and does not constitute a partnership, joint venture, employer/employee arrangement or similar relationships.

 

HOW TO ORDER GOODS ON THE WEBSITE

2.1. To use the Services, you must create an account with Shopalong (“Account”). Shopalong will require your banking details to effect payment.

2.2. Through your Account, you can use the online shop button to purchase goods from the farm you have selected (“Order”).

2.3. To confirm your Order, review your cart and press the check-out button, whereby you will be transferred to our secure payment platform.

2.4. Doorbell Deli uses Peach as the payment gateway to keep your credit card details secure. Your payment will be subject to the Peach Payments Terms and Conditions.

2.5. Shopalong will confirm your Order by sending you a confirmation email (“Order Confirmation”). Should there be any error in your Order Confirmation, kindly contact Shopalong at info@shopalong.co.za immediately to resolve same.

2.6. Prices are subject to change at any time and all goods shown on the Website are subject to availability.

 

DELIVERY OF YOUR ORDER

3.2. The information you provide for your Account must be accurate, current and complete. You are responsible to update such information as and when it changes. In addition, you are responsible for your Account and should not share your log- in details or password with anyone.

3.4. It is your sole responsibility to ensure that your Order is accepted in person upon delivery. You can request a different person to accept your Order, but this is done at your own risk.

3.5. In the event that you are unable to accept delivery, Shopalong will hold the Order at unit 1, Masons Press, 7 Ravenscraig rd Woodstock, Cape Town to be collected by you.

3.6. Shopalong will use its best endeavours to ensure that your Order is delivered, however Shopalong cannot accept any liability for uncollected deliveries.

 

COMPLIANCE WITH LEGISLATION

4.1. Shopalong will comply in full with the Consumer Protection Act 68 of 2008 (“CPA”) in relation to you and in conjunction with the supplier, which includes observing the provisions relating to quality of goods, return policy for goods and any other relevant provisions.

4.3. The information you provide to us on the Website will be held in compliance with Protection of Personal Information Act 4 of 2013 and will only be used for the purpose of contacting you for delivery and promotional offers.

 

REFUNDS AND RETURNS

5.1. Any/all items purchased from Shopalong must meet the following requirements to be eligible for a refund or exchange: Item(s) must be in Original Packaging, and Brand New condition. Return must include an original invoice from Shopalong. Shopalong reserves the right to deny any return or exchange and may request additional information as a condition of a return or exchange. We strongly recommend you insure your package(s) as we are not liable for items that are lost or damaged while in transit. Shipping services purchased by the buyer in relation to the original purchase, including but not limited to, upgraded and international shipping are the sole responsibility of the buyer and are non-refundable. This return policy is only available to customers of the South Africa. We will do our best to accommodate such a request within our discretion but at the same time keeping you, the customer, satisfied. Shopalong reserves the right to amend this Return Policy at any time. Shopalong reserves the right to refuse a return for any reason.

 

WEBSITE USE

6.1. Shopalong will take all reasonable security measures to ensure the safety and integrity of the Website and to exclude any virus, unlawful access and/or monitoring of the Website but does not give any further warranty or make any representation that the Website will operate error free or without interruption. You use the Website at your own risk.

6.2. You agree that you will only use the Website for its authorized purpose and will not sell, modify, distribute, copy or reverse engineer any part of the Website or Services.

6.3. Shopalong reserves the right to deny you access to the Website where Shopalong believes in its reasonable discretion that you are in breach of these Terms.

 

REMOVAL OF YOUR ACCOUNT

7.1. If you wish to remove your Account from the Website, you may do so by deregistering your Account with Shopalong and discontinue using the Website.

7.2. Shopalong reserves the right to cancel your Account if you breach any of the Terms, or for any other reason provided that Shopalong gives reasonable notice to you with written reasons for the cancellation.

7.3. In the event of cancellation, Shopalong will purge your Account information from its database.

 

INDEMNITY AND LIABILITY

8.1. Apart from instances of dishonesty or gross negligence, you agree to indemnify and hold Shopalong harmless from and against any and all actions, claims, demands, proceedings or judgments (collectively “claims”) and any and all losses, liabilities, damages, costs, charges, and expenses (collectively “losses”) of whatever nature, which may be instituted, made or alleged against, or are suffered or incurred by you relating to the delivery of the Order, the goods, Services or the Website.

8.2. In addition, Shopalong will not be responsible for any damage suffered by you as a result of incorrect or outdated Account information or your failure to collect the delivery.

8.4. You will be responsible for all transactions that take place using your account.

 

INTELLECTUAL PROPERTY

9.1. Shopalong grants you a limited, non-exclusive, non-transferable and revocable license to use the Website for its intended purpose, subject to your compliance with the Terms.

9.2. You retain all rights to the information that you upload or submit. You further grant Shopalong a non-exclusive, royalty-free, worldwide license to use your contact details to contact you and deliver your goods. This license will terminated upon termination of this agreement, for whatsoever reason.

 

DISPUTE RESOLUTION

10.1. Should any dispute, disagreement or claim arise between the parties concerning the Website or Order, the parties shall endeavour to resolve the dispute amicably, by negotiation, and with the best interests of both parties in mind.

10.2. Should the parties fail to resolve such dispute in the aforesaid manner or within such further period as the parties may agree to in their negotiation, the parties will approach an independent industry expert who shall mediate the discussion on their behalf.

10.3. The parties both agree that in no circumstance will either party publicize the dispute on any social media or other public platform. The parties understand that any publicity of this nature can cause serious damage to the other party, which damage may result in a financial claim.

Each of the parties choose domicilium citandi et executandi (“domicilium”) for the purposes of the giving of any notice, the payment of any sum, the serving of any process and for any other purposes as being:

FORCE MAJEURE

If either party is prevented, whether in whole or in part, or delayed from performing any of its duties, functions or obligations under these Terms, whether timeously or at all, due to an act of God (which for the purposes hereof shall mean political riots, civil commotions, legal prohibitions or restrictions, fire, floods, storms, earthquakes, load-shedding or other similar natural disasters), then such failure shall not constitute a breach under the Terms, and the obligation to perform shall be suspended to the extent and during the continuance of such prevention provided that the parties shall use their reasonable commercial endeavours to minimise any delay occasioned thereby.

 

GENERAL TERMS

13.1. Queries or Complaints: Should you have any complaints or queries, kindly address an email to info@shopalong.co.za advising Shopalong of same.

13.2. Ability to Alter Terms: Shopalong reserves the right to amend these Terms in its sole discretion from time to time and will post the updated Terms on the Website. If you do not agree with the Terms, you should discontinue using the Services and accessing the Website.

13.3. Survival of Rights, Duties and Obligations: Termination of this agreement for any cause whatsoever shall not release either party from any liability which at the time of termination has already accrued to the other or which thereafter may accrue in respect of any act or omission prior to such termination.

13.4. Variation: No alteration, consensual cancellation, variation of, or addition to this agreement shall be of any force or effect unless reduced to writing and signed by both parties.

13.5. Indulgences: No indulgence, leniency or extension of time granted by Shopalong grants or shows to you shall operate as an estoppel or in any way prejudice Shopalong or preclude Shopalong from exercising any of its rights in the future.

13.6. Severability: Each sentence, paragraph, term, clause and provision of these Terms and any portion thereof shall be considered severable and if, for any reason, any such sentence, paragraph, term, clause or provision is held to be invalid, contrary to, or in conflict with any applicable present or future law or regulation (including, without limitation, the CPA, Food related legislation and any regulations thereto) or in terms of a final, binding judgment issued by any court, it shall to that extent be deemed not to form part hereof and shall not impair the operation of, or have any effect upon such other sentence, paragraph, term, clause or provision hereof as may otherwise remain valid or intelligible, which shall continue to be given full force and effect and bind the parties hereto

13.7. Governing law: This agreement shall be governed by and interpreted in accordance with the law of the Republic of South Africa. All disputes, actions and other matters in connection with this agreement shall be determined in accordance with such law.

13.8. Cumulative Rights and Remedies: The rights and remedies of the parties under this agreement are cumulative and in addition to any rights and remedies provided by law.

 

5. Payment Terms

6. Age Restrictions

The use of cannabis is highly regulated, and only allowed to be consumed in private, by adults over the age of 18 years. While the recreational use of cannabis in private is legal.

 

7. Warranty and Guarantee

If you are not completely satisfied, you can return the product to us and we will exchange it subject to the below terms.

This Policy forms part of the Shopalong Terms & Conditions, and so words defined in the Terms & Conditions have the same meaning in this Policy, unless the context indicates otherwise. Nothing in this Policy is intended to limit your statutory rights in any way.

My items were delivered damaged. What do I do?

Should an item be damaged (product is squashed or visibly damaged during transit), please send an email to returns@Shopalongfit.com with photos of the damaged item. Damaged goods must be reported to us in this way within 7 days after receiving it. The courier company will then be notified to collect the product from you and once we have received and inspected it, you will be issued with a replacement product. Replacement product will be issued within 7 working days.

You delivered the incorrect item. What do I do?

Should you have received the incorrect item (product, flavour or size) than that ordered, please email returns@Shopalongfit.com. Incorrectly delivered goods must be reported to us in this way within 7 days after receiving it. The courier company will then be notified to collect the product from you and once we have received and inspected it, you will be issued with a replacement product. Replacement product will be issued within 7 working days.

My product is defective. What do I do?

Should an item be faulty or defective (product is impossible to consume or is visibly defected), please send an email to returns@Shopalongfit.com. Defective goods must be reported to us in this way within 7 days after receiving it. The courier company will then be notified to collect the product from you and once we have received and inspected it, you will be issued with a replacement product. Replacement product will be issued within 7 working days.

I have received my correct order but just don’t want it anymore. What do I do?

Should you for some reason no longer want the item that you have purchased and the product is still sealed in its original packaging, please send an email to returns@Shopalongfit.com. At your own accord you will need to notify a courier company and return the product to the below address, at your own cost, and once we have received and inspected it, you will be issued with a replacement product. If the product has been opened and isn’t faulty, you will not be able to return it for a replacement product. Replacement product will be issued within 7 working days.

 

Please note: All shipping of non-defective product returns are for the customer’s account. All confirmed defective, damaged or incorrect items will be shipped for free.

DISPUTES

 

With respect to any dispute regarding SHOPALONGfit.com, all rights and obligations and all actions contemplated by these Terms & Conditions shall be governed by the laws of RSA, as if the Terms & Conditions were a contract wholly entered into and wholly performed within RSA. Any dispute relating in any way to the user’s visit to SHOPALONGfit.com shall be submitted to confidential arbitration in RSA, except that, to the extent he has in any manner violated or threatened to violate our intellectual property rights or the intellectual property rights of our affiliates, partners or licensors, we may seek injunctive or other appropriate relief in any court and he consents to exclusive jurisdiction and venue in any such court. Arbitration under this agreement shall be conducted under the rules then prevailing in the RSA. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

 

CHANGES TO AGREEMENT AND TERMINATION
